Measures for Optimizing the Service Mechanism for “Rapid Approvalof Industrial Projects” in Guangzhou Development District (Huangpu District)
为全面贯彻党的二十大精神和习近平总书记视察广东重要讲话、重要指示精神,落实市委“干部作风大转变、营商环境大提升”专项行动工作要求,围绕“审批大提速、效能大提升”进一步精简优化审批服务,高效推进工业项目落地建设,全力打造更好更优营商环境,结合我区实际情况,特制定本措施(简称“工业快批”3.0)。
In order to fully implement the spirit of the 20th National Congress of the Communist Party of China (CPC) and theguiding principles of General Secretary Xi Jinping’s important speeches and instructions during his inspection of Guangdong, as well as the requirements of the CPC Guangzhou Municipal Committee’s special action of “Making major changes in officials’ work style and great improvement in business environment”, the Measures (“Rapid Approval of Industrial Projects 3.0” for short) are hereby formulated based on the actual conditions of the District, with the focus on “greatly accelerating the approval process and enhancing the approval efficiency” by further streamlining approval services to promote the implementation of industrial projects and create a better business environment.
本措施适用于广州开发区、广州市黄埔区管理范围内工业用地建设项目的相对集中行政许可及相关审批服务工作。
The Measures apply to relatively centralized administrative licensing and related approval services for industrial land construction projects within the administration of Guangzhou Development District and Huangpu District.
第一条 扩大环评承诺制全信任审批范围
Article 1 Expanding the full-trust approval scope of the environmental impact assessment commitment system
将环评承诺制全信任审批范围由检验检测类实验室扩大至安全环境影响可控的实验室、食品制造和生物医药行业。对纳入环评承诺制全信任审批的项目,区行政审批部门在企业提交承诺书后即可作出审批决定,并在审批通过后3个月内对环评文件进行检查。
The full-trust approval scope of the environmental impact assessment commitment system will be expanded from test laboratories to laboratories with controllable safety and environmental impact, food manufacturing and biomedical industries. For included projects, theDistrict’s administrative approval bureau is entitled to make an approval decision after an enterprise submits a letter of commitment, and will inspect the environmental impact assessment documents within three months after the approval.
企业应严格落实承诺和相应环境管理要求。具体安全环境影响可控范围和标准,由区行政审批部门结合建设项目环境影响及周边环境敏感点情况予以明确。(责任单位:区行政审批局)
Enterprises should strictlyfulfill their commitments and abide by corresponding environmental management requirements. The specific controllable scope and standards of safety and environmental impacts shall be clarified by the District’s administrative approval bureau based on the environmental impacts of construction projects and the conditions of sensitive points in the surrounding environment. 第二条 优化涉及轨道交通规划线路项目的审批程序
Article 2 Optimizing the approval procedures for planned rail transit line projects
由区规划和自然资源主管部门会区规划审批部门建立轨道交通规划审批的快速协调机制。
TheDistrict’s planning and natural resources bureau and planning approval bureau shall establish a rapid coordination mechanism for rail transit planning approval.
涉及远期规划的轨道交通线路,且规划建筑在轨道交通中心线两侧各扩25米宽度范围之外的工业项目,区规划审批部门可先行规划审批。项目方应在开工前取得轨道交通主管部门支持意见。取得意见存在困难的,启动快速协调机制推进解决。
For industrial projects involving long-term planned rail transit lines and planned buildings 25 meters away from both sides of the rail center line, theDistrict’s planning approval bureau may give planning approval first. The project should obtain support from the rail transit authority before starting construction. If there are difficulties in obtaining support, the rapid coordination mechanism shall be activated to facilitate settlement.
涉及已建成或已纳入近期建设计划的轨道交通线路管控范围的工业项目,或规划建筑位于远期规划轨道中心线两侧各扩25米宽度范围内的,启动轨道交通快速协调机制推进解决。(责任单位:区规划和自然资源局、区行政审批局、知识城合作事务办)
For industrial projects involving rail transit lines that have been completed or have been included in recent construction plans, or where planned buildings are located within 25 meters on both sides of the long-term planned rail center line,the rail transit rapid coordination mechanism shall be activated to facilitate settlement. (Responsible departments: Planning and Natural Resources Bureau, Administrative Approval Bureau, and Knowledge City Cooperation Affairs Office of the District)
第三条 优化“两重点一重大”安全控制范围项目审批程序
Article 3 Optimizing the approval procedures for projects within the“two key and one major” safety control scope
区规划和自然资源主管部门争取上级支持,将区应急主管部门编制的区“两重点一重大”项目安全控制范围成果纳入市“多规合一”平台。
TheDistrict’s planning and natural resources bureau shall seek support from its superiors to incorporate the achievements in the complication of industrial project safety control scope related to “hazardous chemical processes and hazardous chemicals under key supervision and major hazard sources” of the District’s emergency management bureau into a platform which combines multiple regulations into one.
对属于安全控制范围内或涉及“两重点一重大”的新出让工业项目,由区招商引资部门在项目确定用地选址后告知意向单位编制安全风险评估报告事宜。对于属于安全控制范围内或涉及“两重点一重大”的存量工业项目,由区规划审批部门告知项目方应编制安全风险评估报告事宜。由区应急主管部门前置服务,指导企业编制安全风险评估报告。
For newly transferred industrial projects that fall within the scope of safety control or involve the“hazardous chemical processes and hazardous chemicals under key supervision and major hazard sources”, the District’s investment promotion bureau shall inform the interested entities of the preparation of safety risk assessment reports after the project site is determined. For existing industrial projects that are within the scope of safety control or involve the “hazardous chemical processes and hazardous chemicals under key supervision and major hazard sources”, the District’s planning approval bureau will inform the project of preparing a safety risk assessment report. The District’s emergency management department is responsible for providing pre-services and guiding enterprises in preparing safety risk assessment reports.
项目规划审批过程中,区规划审批部门就企业编制完成的安全风险评估报告征求区应急主管部门意见,区应急主管部门应于3个工作日内回复明确意见。其中,回复无实质修改意见的,由区规划审批部门按程序开展规划审批工作;回复有不同意见的,由区应急主管部门负责指导企业修改完善。项目安全风险评估报告经修改完善符合安全管控要求的,区应急主管部门应函告规划审批部门。(责任单位:区投资促进局、区工业和信息化局、区规划和自然资源局、区应急管理局、区行政审批局、知识城合作事务办)
During the approval process, theDistrict’s planning approval bureau shall solicit opinions from the District’s emergency management department on the safety risk assessment reports prepared by enterprises, and the latter shall respond with clear opinions within three working days. If there are no substantive modifications in the reply, the former shall carry out planning approval according to relevant procedures; if there are different opinions in the reply, the latter shall be responsible for guiding enterprises to make modifications and improvements. If the project safety risk assessment report, after modification and improvement, meets safety management and control requirements, the District’s emergency management department shall notify the planning approval bureau in writing. (Responsible departments: Investment Promotion Bureau, Industry and Information Technology Bureau, Planning and Natural Resources Bureau, Emergency Management Bureau, Administrative Approval Bureau, and Knowledge City Cooperation Affairs Office of the District)
第四条 优化建筑工程项目规划设计方案审批程序
Article 4 Optimizing the approval procedures for planning and design plans of construction projects
符合以下情形之一的,建筑工程项目可以免于单独申请办理设计方案审查,直接申请办理建设工程规划许可证:
Ifany one of the following conditions is met, a construction project may be exempted from applying for a separate design plan review; instead, it is entitled to directly apply for a construction project planning permit:
(一)规划新建建设项目时,仅建设一幢建筑物且建筑高度≤60米;
1.When planning a new construction project, only one building with a height of 60 meters or less is to be constructed;
(二)建设用地面积≤10000平方米的地块,在规划新建建设项目时,规划建筑高度≤60米或计算容积率建筑面积≤20000平方米;
2.For land parcels with a construction land area of 10,000 square meters or less, when a new construction project is planned, the planned building height is no more than 60 meters or the total floor area is no more than 20,000 square meters;
(三)加建、改建、扩建建设项目时,建筑面积≤5000平方米。
3.When adding new building structures or parts to the existing building foundation, or reconstructing/expanding construction projects, the construction area is no more than 5,000 square meters.

第五条 优化“带方案出让”项目规划设计方案调整的审批程序
Article 5 Optimizing the approval procedures for the adjustment of planning and design plans of projects“transferred with inherent plans”
对于已取得国有土地使用权的“带方案出让”项目,如需对所带“方案”进行调整,符合以下情形的,可免于单独申请办理设计方案调整,直接申请办理规划报建手续:
Fora project “transferred with inherent plans” that has obtained state-owned land use rights, if the plans need to be adjusted, the project is entitled to be exempted from applying for a separate design plan adjustment and directly apply for planning and construction application procedures when meeting any of the following conditions:
(一)调整规划指标不超出土地出让合同附件规划总平面图相应指标的;
1. The adjustments to indicators are within the corresponding indicators of the general plan attached to the land transfer contract;
(二)涉及建筑外立面调整,经行业专家评审或区规划审批部门认定属于正向优化的。

2. The adjustments to building facades have been identified as positive optimization by industry experts or theDistrict’s planning approval bureau.

第六条 优化接驳排水审批程序
Article 6 Optimizing the approval procedures for connecting drainage facilities
对排水设施工程建设完工的,企业可申请合并办理“公共排水设施接驳核准”与“城镇污水排入排水管网许可证核发”。(责任单位:区水务局、区行政审批局)
After a drainage facility project is completed, the enterprise can apply for the combined approval of “connection of public drainage facilities” and “issuance of license for urban sewage discharge into drainage pipe networks”. (Responsible departments: Water Authority and Administrative Approval Bureau of the District)
第七条 优化绿化管理事项审批程序
Article 7 Optimizing the approval procedures for greening management
纳入全信任筹建的工业项目,因开设机动车出入口需迁移市政树木的,由区行政审批部门向区绿化和公园管理中心出具协助企业迁移城市树木的函,区绿化和公园管理中心具体实施。项目方取得用地手续后补交相关材料完善行政审批。(责任单位:区行政审批局、区绿化和公园管理中心)
For industrial projects included in full-trust preparation and construction, if municipal trees need to be relocated due to the opening of motor vehicle entrances and exits, the District’s administrative approval bureau shall issue a letter to the District’s greening and park management center to assist the enterprise in relocating the trees, and the center shall be responsible for the relocation. After obtaining the land use procedures, the project shall submit relevant materials to complete the administrative review and approval. (Responsible department: Administrative Approval Bureau and Greening and Park Management Center of the District)
第八条 优化路口开设审批程序
Article 8 Optimizing the approval procedures for building intersections
加强协同,进一步完善路口开设审批流程,推动工业用地项目筹建。
TheDistrict will improve the approval process for building new intersections for the preparation of industrial land projects.
(一)优化开设机动车出入口涉及未移交市政管养道路的审批。工业项目需在未移交市政管养道路开设机动车出入口的,由区市政设施管理中心和区财政投资建设项目管理中心出具意见,区行政审批部门结合相关意见进行审批。(责任单位:区住房城乡建设局、区行政审批局、区市政设施管理中心、区财政投资建设项目管理中心)
1. Optimizing the approval of motor vehicle entrances and exits involving roads that have not been transferred to municipal management. If an industrial project needs to build a motor vehicle entrance or exit on a road that has not been transferred to municipal management, theDistrict’s municipal facilities management center and financial investment and construction project management center shall provide opinions, based on which the District’s administrative approval bureau shall be responsible for project review and approval. (Responsible departments: Housing and Urban-Rural Development Bureau, Administrative Approval Bureau, Municipal Facilities Management Center, and Financial Investment and Construction Project Management Center of the District)
(二)优化开设机动车出入口涉及占用其他用地的审批。工业项目开设机动车出入口占用未出让的政府储备用地的,由区行政审批部门先行办理占用挖掘城市道路许可手续;占用其他权属人用地的,由区行政审批部门先行办理占用挖掘城市道路许可手续,并告知土地权属人。工业项目与土地权属人协商一致后再行实施。区规划和自然资源部门负责完善相关手续。(责任单位:区规划和自然资源局、区行政审批局、区土地开发储备交易中心)
2. Optimizing the approval of motor vehicle entrances and exits involving occupying other land. If an industrial project builds a motor vehicle entrance and exit which occupies un-transferred government reserve land, theDistrict’s administrative approval bureau must first handle the approval procedures for occupying and excavating urban roads; if it occupies other land owned by other property owners, the District’s administrative approval department must first handle the approval procedures for occupying and excavating urban roads, and then inform the land owner. Industrial projects can only be implemented after reaching an agreement with the land owner. The District’s planning and natural resources bureau is responsible for completing relevant procedures. (Responsible departments: Planning and Natural Resources Bureau, Administrative Approval Bureau, and Land Development, Reserve and Trading Center of the District)
(三)优化机动车、人行出入口开设规划审批程序。对于已取得规划批复的工业项目,因避让地上、地下设施或树木等其他情形,需要调整机动车出入口位置的,在符合《黄埔区地块出入口开设技术指引》的情况下,免于规划调整手续,直接办理占用挖掘城市道路许可等手续。工业项目开设人行出入口的,免于单独规划报批。(责任单位:区行政审批局、知识城合作事务办)
3. Optimizing the planning approval procedures for building entrances and exits for motor vehicles and pedestrians. For industrial projects that have obtained planning approval, if the location of motor vehicle entrances and exits needs to be adjusted to avoid above-ground or underground facilities, trees or other circumstances, they shall be exempt from the planning adjustment procedures and directly apply for permissions to occupy and excavate urban roads and other procedures if they comply with the Technical Guidelines for the Building of Entrances and Exits of Land Parcels in Huangpu District. For industrial projects to build pedestrian entrances and exits, they are exempt from separate planning and approval. (Responsible departments: Administrative Approval Bureau and Knowledge City Cooperation Affairs Office of the District)
(四)纳入信任筹建的项目用地手续与开设机动车出入口手续同步办理。纳入信任筹建项目在办理用地手续过程中,区行政审批部门向项目方出具支持开设机动车出入口的意见,项目方自行建设。(责任单位:区公安分局、区住房城乡建设局、区企业筹建服务局、区行政审批局、区市政设施管理中心)
4. The land use procedures for projects included in full-trust preparation and the procedures for building motor vehicle entrances and exits shall be handled simultaneously. When the land use procedures are being handled for projects included in the full-trust preparation, the District’s administrative approval bureau shall provide opinions to the project to support the building of motor vehicle entrances and exits, and the project shall be responsible for building. (Responsible departments: Public Security Bureau, Housing and Urban-Rural Development Bureau, Enterprise Preparation Service Bureau, Administrative Approval Bureau, and Municipal Facilities Management Center of the District)
